By placing a commission you are confirming that you are over the age of 18 and have read and agreed to all the following terms no exceptions. You are also confirming that any funds you would provide for your commission are yours to use.Please be aware that I am disabled and chronically ill. My hours of operations will vary based off my overall health. Please permit at least a 3 day grace period for returns in messaging, especially if outside of the following hours. All times listed are in CST. Please be aware that while I do my best to be on time; Due to my chronic illness I cannot guarantee delivery dates 100% of the time. If you require delivery within a certain time frame please account for additional delay time in your scheduling.

NFT & AI

Absolutely zero use of my work is permitted for NFTs or submissions, uploads, ect in AI generation databases. Any attemps to do so will result in a permanent blacklisting and potentially legal action.
I reserve the right to refuse service to anyone who is found to partake in the use of NFTs or AI generation. Additionally I reserve the right to keep any payments made in the event of cancellation due to NFT or AI generation use.
If commission is cancelled due to the prior reasoning client does not maintain any rights over works that may have already been in production. Partaking in either is considered an immediate forfeit over any and all rights to current and previous commissioned works.

commercial work upcharges

Artist may allow royalty fees instead of merchandising upcharge at artist disgression.
Artwork copyrights are retained by the Artist (me) and I retain the rights to reproduce the art in the future unless otherwise compensated for in the form of paying the fee for specific rights.The following services already have commercial fees included in the listed price: Live2D Modeling & Rigging, PNGTubers, PNGTubers+, GIFTubers, Character Design, Outfit Design, Any & All services listed under "Stream Assets".

Payment Plans

Payment plans are currently only available for returning clients with good standing.
Please understand that this is for the artist's own protection.If a larger project is needed, or if you're interested in pursuing several services, a payment plan may be permitted upon request. This will likely require the first (or a smaller service) to first be paid in full prior to assembling a payment plan for the alrger project(s).Please know multiple missing payments without communication with the artist to discuss options will result in a permanent blacklisting.

Waitlist & Closed commission requests policy

Commission requests placed during times in which the current commission openings are marked as "waitlisted" or "closed" will be subjected to a convenience fee. The convenience fee is a flat fee of $50 in order to be added to queue outside normal slot openings. This fee is nonrefundable even in the event of a cancellation. This is simply a fee for the slot time, and being able to beat the potential wait of when the artist reopens commissions. This convenience fee may be waived at artist disgression based on personal estimation of current queue times.

Cancellation & refund policy

No refunds are permitted once work has started.
Clients receive a 48 hour grace period after the commission has been accepted to receive a full refund.
Refund requests after this alotted time will result in a cancellation fee of 25%-50% the expected value of the commission for queue time and space lost at artist disgression.

General Terms of service information

Payments must be made in full prior to the beginning of work, unless prior authorization has been given.
All services except the following include commercial use rights in the listed price:

The previously listed services are for PERSONAL USE ONLY without an upcharge unless listed otherwise.
Client is not permitted to remove the artist's signature or watermarks. Chargebacks are only permitted with permission from the artist. The client will be offered two revisionary periods: after the initial sketch, and at the end of the project for all commission types EXCLUDING YCH's (Your Character Here's). YCH's only receive a revisionary period at the end of the project. The client is welcome to request any alteration within reason during these periods.Alteration to composition will not be honored if requested at the end of the project, or to YCHs which function off a base. Client's approval of the initial sketch will be considered satisfaction in the composition. Larger or complex alterations may incur a complexity fee.Full reference sheets will be required at the time of order, except when commissioning a character or outfit design. Any request without a reference sheet, or an insufficient reference sheet will be rejected.
Examples of sufficient and insufficient reference sheets are provided below.

If you have an insufficient reference sheet please consider commissioning the artist for either a character design or reference sheet as needed for your situation. Having a clear and concise character sheet is great help if you're someone who regularly commissions artists to get your design right the first time and saves everyone a lot of time and headache.

Artist will receive credit on all social media platforms in which their work is used. This could be an @ to the artist when posting on social media, including them in the credits section of your about page/bio, or linking back to the artist with the included work. Please do not be afraid to @ the artist directly to provide credit. (They like seeing it.) Artist will NOT request royalties on any payment received from the use of commissioned Live2D Models, Character Designs, or other assets used in commercial rights useage.
The required e m o j i in order to prove you have fully read the terms of service is presently: blowfishIf a piece is needed by a specific date, this must be discussed with the artist prior to placing the commission request. Commissioned pieces with a required due date wil be subjected to a locked delivery fee and potentially a rush fee depending on the amount of time provided. Both fees are only refundable if no work has been started.

Service specific terms of service

Live2D Modeling and Rigging commissions will receive a grace period of 2 months for any edits and alterations that may need be made. Alterations after this period of time are not permitted. My work and art style are regularly evolving and I cannot guarantee edits after the 2 month period will still be cohesive enough to feel satisfied with my work.Character & Outfit Design commissions that result in cancellation will not result in a refund if work has already begun. Additionally client loses any and all rights to any designs created by the artist, and the design will be resold online.Any design or works created for a design made by @spacetrashvt may not be resold even in the event of quitting vtubing / content creation activities without prior authorization by the artist. This includes disclosing who the client is selling the design to. The individual buying the design must also agree to the same terms the original client agreed to.
